Midaria Feebee's Terms Of Service

This Terms of Service Agreement is entered into between myself, Midaria Feebee ("I" "me"), and the Client ("You"), for purchase of any character adopt (“Design”), commissions, 3D art, Sewing pieces, or any other products.
I act as a micro-entrepreneur artist registered in France under SIRET 98921771600012.❥ The Client’s agreement to these Terms of Service must be explicit. Before confirming any commission, I will ask: “Do you agree to my Terms of [Current Date] ?”followed with this document link.
You must provide a clear written confirmation (e.g. “Yes, I agree”) , and I will keep a record of this confirmation as proof of acceptance.Please take the time to read all of itBlacklist's link
ʚ General Terms ɞ
❥ These terms can and will change at any time , this will be notified on my socials and/or via email or private messages to Clients with ongoing commissions. Commissions already started follows terms from the date of confirmation specified at acceptance of terms. Read them each time you need to anyway.
❥ Stay respectful, this goes without saying : Disrespect, Harassment, LGBT+phobia, racism etc. Will not be tolerated.
❥ I have the right to refuse your commission for any reason (Which are not based on any kind of personal discrimination but likely because of any general issues as illegal activities, no slots available at the moment, personal circumstances or health issues, etc)
❥ Turnaround time may vary depending on the amount of work I have and personal situation.
❥ WIPs will be sent only if requested, don’t be scared to ask but stay understanding and polite !
❥ The signature(s) (these may be watermarks) will remain on the drawing at all times. You can ask me to move it but it must stay.
❥ Please do not make last minute modifications, I will send you a quick sketch and it will be your last chance for big modifications !❥ Breach of Terms :
In case of breach of the present terms by the Client, I reserve the right to cancel the commission.
In such case, the Client will be refunded proportionally to the work already completed.
Example: if a fully rendered artwork was commissioned but the cancellation occurs at the line art stage, the Client will be refunded the difference between the price of a rendered piece and the price of a line art, and will keep the line art created.
You also can be blacklisted if you become aggressive, too intrusive or if you did it 1 or 2 times, depending on the gravity.❥ Do not try to scam me you will be blocked and reported to the platform.❥ Please contact me by email to place your order, to avoid contact issues as my/your social media account being disabled or hacked : [email protected]❥ Blacklist :
Individuals on my blacklist may not place new orders or obtain any commission directly from me.
Any Client who knowingly attempts to circumvent this rule by purchasing on behalf of a blacklisted person may also be subject to blacklisting.
However, once a physical or digital work has been sold, I cannot legally prevent its resale to third parties; in such a case, only the license/usage rights initially granted remain limited, and no new rights will be recognized for blacklisted individuals.
❥ In case of violation of these Terms, the Client may be added to a public blacklist. Only the Client’s username (alias) will be displayed, without any further explanation or personal data. This measure is solely intended to protect my rights and prevent further transactions.
❥ Clients are not permitted to know why an individual is blacklisted, and I am not obligated to explain.
❥ No harassment will ever be tolerated in both ways, Blacklisting an individual is only up to me, do not try to defend them, nor harass them back on behalf of me.
❥Never use or share my deadname, modifications takes time and you might be blacklisted❥ The Client acknowledges that I speak French and English (Not 1st language), and will only provide service in English and French. Miscommunication due to a language barrier is not at my fault.ʚ I Can Draw ɞ

I will ask for proof of age, such as your ID card (you must hide personal information and include a paper with your nickname and the current date; I only need your date of birth). I will dispose of it immediately after validation.
❥ If the client is a minor, I may discuss the request with their legal guardian directly, for any kind of request.
ʚ Original Designs ɞ
❥Do not resell my designs for more than the price you have paid for them. Except :
- If you purchased commission art from other artists (You must provide proof of purchase)
- You added personal artworks
❥ If personal artworks added, please *respect your own official prices
❥ You can use your new character however you want, stories, mascot, sona,... but don't forget to credit me/ link to my socials or Carrd (excluding commercial usage which need to be discused)
❥ If you make direct profits by using my design, it will be considered as commercial usage(please refer to "Commercial Rights")
❥ Designs may not be used to promote or ease propaganda, xenophobia, racism, disturbing fetish art, or any paraphillias.
❥ My credit should not be removed from any Design, regardless of if it is changed or updated by the Client.
❥ Clients agree to follow the refund policy; any charge-backs may result in the design being re-listed for sale.
❥ In case of auctions : Clients must have their offered amount on hand unless stating a payment plan is needed. In auctions, it is assumed you have the amount on hand. Payment plans will not be accepted unless requested before bidding.❥ All designs must have a Toyhou.se page created by myself. Clients without Toyhou.se will be given a code (if I have one available). This profile should not be deleted or hidden from me (I must be authorized)
❥ You may Co-Own my Designs. But you may not come to me if there are any issues between you or the co-owners(s). It is not my responsibility.
I also ask that only one (1) Toyhouse character profile exist per/ character.
❥ You cannot resell/trade a design for seven (7) days after receiving it.
❥ I refuse to copy any existing character you do not own rights of into another specie. I can only take some inspirations at maximum.
ʚ Bases (2D/3D) ɞ
❥ Includes Free To Use, Pay To Use bases, 3D avatars, 3D prompts, 3D clothes, Patterns (Non-exhaustive list)
❥ Always credits me but avoid doing it on my ToyHou.se account as your usage will be added to my personal arts
❥ If you obtained one of my works for free, please consider buying it and/or supporting me through my Kofi or Streams if you can, it's gladly appreciated !
❥ If a commission is taken using one of my 3D bases or sewing patterns (excluding 2D bases), it is preferable that both parties purchase the product. However, it is acceptable if only the commissioner purchases it, even if the other party already owns the model. You must purchase the base.
❥ Do not use my 2D bases for paid commissions
❥ You can use my 2D bases to make and sell original designs and make gifts
❥ You can edit my bases however you want, but keep the original credits while sharing
❥ No refunds on digital products
❥ You can reference my work but do not trace it
❥ Be careful when downloading my work on unofficial websites beside my socials and websites, it might contains malwares
❥ You can ask me to do a commission on one of my bases !
ʚ Payment ɞ
❥ Only payments via PayPal or Stripe are accepted. You must be +18 or have your legal guardian's written confirmation.
❥ Clients must not send money before permitted.
❥ Invoices must be paid within 48 hours, or the offer may be canceled.
❥All prices are listed in € (Euros). Devises conversions are at your charge
❥ In the case of a payment plan, the Client must pay and agreed upon amount of the total artwork cost up front, and the rest in an agreed upon time-frame indicated on quote.
❥ If the agreed payment plan is not respected, the Client may be charged a reasonable late fee to compensate for actual inconvenience and administrative costs caused by the delay. For example, time spent on reminders, disruption of scheduling, and transaction fees. Normally, this fee is set at 20€, which reflects the typical costs for delayed payments on my productions, but it may be adjusted if the actual loss is higher or lower.
❥ By agreeing to the payment plan, the Client accepts that this late fee is reasonable and proportionate to the actual damages caused by delayed payment.
❥ Once the payment plan has begun, the money is no longer refundable from “buyers guilt” or any other non-serious reason.
❥ I will only finish once I have received full payment. It mean you can pay before sketch validation and you must pay at its validation.
❥ Prices can not be negotiated once you choose your options.
❥ I will provide you with a quotation that includes the cost, estimated timeline, and any additional terms specific to your commission.
❥ If the character or scene is too complicated or detailed, I have the right to charge extra for it. ( complexity fees ) Which are discussed beforehand.
❥ There is fees for NSFW arts
❥ For more than one character, it will be charged as 75% of original one's price. If I consider the new character is complex it will count as 100% of the original price.
❥ Full Refunds can only be made if I have not yet started your commission after quick sketch.
❥If the commission has been cancelled after I started it, The Client will be refunded proportionally to the work already completed.
Example: if a fully rendered artwork was commissioned but the cancellation occurs at the line art stage, the Client will be refunded the difference between the price of a rendered piece and the price of a line art, and will keep the line art created.
❥ Once the drawing has officially started, the Client may no longer exercise their statutory 14-day right of withdrawal under French consumer law, provided that the Client explicitly agrees to the immediate start of the service at the time of order. By confirming the commission, the Client acknowledges that they waive their right of retraction and accept that refunds will only be issued in accordance with the Refund Policy described above.
❥ Correction of mistakes made by me will be free of charges.
❥ All shipping costs ,if shipping is asked for any traditional realization,will be at your charge, this includes envelope/cardboard, taxes and shipping cost. I am localized in France
❥ All shipments are made from France with tracking. I remain legally responsible for delivery until the package is received by the Client (art. L216-2 Code de la consommation).
To reduce risks, the Client may choose insured shipping. In case of loss or damage, compensation will be handled in accordance with the carrier’s insurance coverage. Without insurance, compensation may be limited to the amount reimbursed by the carrier.
ʚ Rights & Usage ɞ
My commissions are for personal use only, if you plan to use my art in a commercial way talk to me to come to an agreement ( refer to "Commercial Rights")
❥You are buying an illustration, not the rights of the same one, you do not have the right to be credited as the creator of it.
❥You can not profit by any means from my artwork.❥Artist Rights :
I retain copyright and intellectual property rights, which includes but is not limited to display and advertising the Design on websites, social media, portfolios, public broadcast channels (i.e. Twitch) and more.
unless otherwise specified for serious reason. As confidential artworks, private themes, gifts,...❥You can publish the finished commissions with the respective credits.
Meaning : display on social media accounts for promotional purposes with no direct monetization , such as profile pictures, banners, wallpaper's device and posts; print and framing in personal spaces; display as part of designs on websites and channels, excluding use in content of these websites or channels with appropriate credit.
(You can to it for yourself or gifts but nothing else)
❥ If you want to edit the original art personally, ask before hand
ʚ Commercial Rights ɞ
❥ Commercial usage rights are not included unless agreed upon during the quoting process. Commercial rights means usage of Design on streams, videos and other content, or any monetized instances
❥ Usage of Design for AI (artificial intelligence) scraping tools, platforms or programs; AI or ML (Machine Learning )training; NFT; blockchain; or other for-profit platforms/purposes, is strictly prohibited, no matter the instance.
❥ Additional charges will be required for commercial usage. For larger projects (Games, webcomics, etc.) Royalties may be discussed.
❥ Any transfer of commercial rights must be the subject of a distinct written contract. This contract will specify, in accordance with French law, the duration, the territory, the media and formats of exploitation, as well as the type and amount of remuneration (forfaitary or proportional royalties). Without such a signed agreement, no commercial rights are considered granted.
ʚIMPORTANT DISCLAIMERɞ
❥ The Client indemnifies me against claims, losses, damages, and expenses related to Work usage by the Client, breach by the Client of the Agreement, or third-party claims.
❥ If Client's rights are violated or the Work is not delivered as agreed, I will work to remedy the situation in a way that suits the Client’s needs.
❥ Arrangements may be discussed in this case but do not expect refunds
❥ If the work happens to arrive but is damages during transport it is possible to send it back for free repairs, but you will need to pay for shipping
❥ If the Client is not honest about their age, the legality of provided references or assets, or any other individual involved without my knowledge, I am not responsible for any damages that may result from Client negligence and the client will be blacklisted.
❥ I HAVE A CAT and CAN NOT guarantee my hand made products to be allergens free.❥ Failure to follow the specified terms may result in cancellation, blacklisting, or justice action depending on the severity of the offense.
Please check if my commissions are open in order to apply for a slot.I may take more time because of personnal complications, thank you for your patience and understandingI will (probably) agree to take commissions on new medium but expect more time as I need to learn at minimal new skills required.
